Metropolitan Council Meeting
Tuesday, June 5, 2007


The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilman Mike Jameson.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Dozier, Neighbors, Tucker, Briley, Dread, Isabel, Hunt, Craddock, Murray, Jameson, Cole, Hart, Forkum, Ryman, Gotto, Burch, White, Loring, Page, Greer, Pepper, Wallace, Walls, Whitmore, Crafton, Evans, Summers, Shulman, Foster, Wilhoite, Hodge, Toler, Coleman, Duvall, Williams, Tygard and President Gentry (37); Absent: Gilmore, Brown, Adkins, Alexander (4).

The Minutes of the regular meeting of May 15, 2007, were approved.

- MAYOR’S MESSAGE -

There being no motion offered pursuant to the mayoral veto of Bill No. BL2007-1372, received and entered into the record of the meeting of May 15, 2007, the veto was sustained.

- COMMITTEE REPORTS ON MATTERS OTHER THAN LEGISLATION -

Upon recommendation of the Executive Committee, the Metropolitan Council will meet on Tuesday, July 10, 2007, in addition to the regular meeting date of July 3, 2007, to conduct the sixty-five public hearings on zoning matters scheduled for that month. Both meetings will begin at 6:00 pm.

The Rules-Confirmation-Public Elections Committee recommended approval of the following amendment to the Rules of Procedure of the Metropolitan Council.

Rule No. 8
Amended by adding the following new paragraph:

“No resolution requesting information or action from a Metropolitan Government department, agency,
board or commission shall be placed on the agenda unless the sponsoring Member of Council has first
requested the information or action by letter at least thirty days prior to filing the resolution. A copy
of the letter requesting the information or action must be attached to the resolution at the time it is filed.”

Ms. Neighbors moved that at the adjournment of this meeting, the Council adjourn to Tuesday, June 12, 2007, at 7:00 pm for the purpose of considering the Capital Improvements Budget (BL2007-1450) on third and final reading, along with any other matters that the President deems appropriate for consideration at that time. The motion was duly seconded and adopted.

- ELECTIONS AND CONFIRMATIONS -

Planning Commission
Reappointment of Ms. Tonya Jones for a term expiring March 31, 2011. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Neighbors moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Plumbing Examiners and Appeals Board
Reappointment of Mr. Martin R. Vanquez-Reyes for a term expiring March 10, 2011. Without objection, the nomination was withdrawn.

Board of Zoning Appeals
Appointment of Ms. Rebecca Lyford for a term expiring February 26, 2012. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Neighbors moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

- BILLS ON PUBLIC HEARING –

BILL NO. BL2007-1398

The Budget Ordinance of The Metropolitan Government of Nashville and Davidson County, Tennessee for Fiscal Year 2008. The bill was approved by the Budget and Finance Committee. Mr. Ryman requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to passage of the bill. Documents were filed in favor of passage of the bill. The President declared the public hearing closed. Mr. Ryman moved to pass the bill on second reading and re-refer the bill to the Budget and Finance Committee, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2007-1450

An ordinance adopting the Capital Improvements Budget and Program 2007-2008 through 2012-2013 for The Metropolitan Government of Nashville and Davidson County as the official Capital Improvements Budget and Program of The Metropolitan Government of Nashville and Davidson County for Fiscal Year 2007-2008. The bill was approved by the Planning Commission, Budget and Finance, and Planning, Zoning and Historical Committees. Mr. Ryman requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. The bill was approved by the Budget and Finance and Planning, Zoning and Historical Committees. Mr. Ryman moved to pass the bill on second reading and re-refer the bill to the Budget and Finance and Planning, Zoning and Historical Committees, which motion was seconded and adopted by a voice vote of the Council.

A resolution providing amendments to the Charter of The Metropolitan Government of Nashville and Davidson County, Tennessee, in accordance with Article 19, Section 19.01, and setting forth a brief description of each amendment to be placed on the ballot. The resolution was approved by the Charter Revision Committee. RESOLUTION NO. RS2007-1944

A resolution adopting a fee schedule associated with the processing and review of certain zoning-related applications (Proposal Number 2007Z-102T). The resolution was approved by the Planning, Zoning and Historical Committee; the Budget and Finance Committee approved an amendment and recommended deferment. Mr. Loring offered Amendment No. 2 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Mr. Loring moved to defer the resolution as amended, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2007-2008

A resolution appropriating to certain accounts for the benefit of the Office of the Trustee, Transportation Licensing Commission and W. O. Smith Music School in the amount of One Million One Hundred Eighty Seven Thousand Dollars ($1,187,000) from designated and undesignated fund balances of the General Fund of the General Services District, increased revenue sources, and from other sources. The Budget and Finance and Public Safety-Beer and Regulated Beverages Committees recommended deferment. Mr. Ryman moved to defer the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2007-2009

Initial resolution determining to issue general obligation bonds of The Metropolitan Government of Nashville and Davidson County in an aggregate principal amount not to exceed Two Hundred Seventeen Million Two Hundred Sixty-Two Thousand Forty-Three ($217,262,043) Dollars to be financed by the ad valorem levy on property in the General Services District and in an aggregate principal amount of Twenty-Three Million Three Hundred Fifty-Seven Thousand Eight Hundred Twenty-Five ($23,357,825) Dollars to be financed by the ad valorem levy on property in the Urban Services District. The Budget and Finance Committee recommended deferment. Mr. Ryman moved to defer the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2007-2010

A resolution authorizing and providing for the issuance and sale of bond anticipation notes in an amount not to exceed Four Hundred Million Dollars in the form of commercial paper of The Metropolitan Government of Nashville and Davidson County (Tennessee); authorizing and providing for a dealer agreement, issuing and paying agency agreement, and standby note purchase agreement; and providing for certain other matters related thereto. The Budget and Finance Committee recommended deferment. Mr. Ryman moved to defer the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2007-2011

A resolution approving an extension of the reimbursement date of the outstanding intra-governmental loan from The Metropolitan Government of Nashville and Davidson County to the Hospital Authority of The Metropolitan Government of Nashville and Davidson County. The resolution was approved by the Health, Hospitals and Social Services Committee; the Budget and Finance Committee recommended deferment. A resolution approving an application to the Tennessee Commission on Children and Youth for state supplement juvenile court improvement funds. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by making applicable the provisions of a Neighborhood Conservation Overlay district to various properties in the Sylvan Park area (612.57) acres, all of which is described herein (Proposal No. 2005Z-180U-07). The bill was approved by the Planning Commission. Mr. Summers moved to withdraw the bill because of the significant conflicting opinions on the proposal, which motion was seconded and adopted by a voice vote of the Council.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing a portion of the property from AR2a to SP zoning located at 7848 McCrory Lane, adjacent to the CSX Railroad and south of Highway 70 (30 acres) to permit 180 townhomes, all of which is described herein (Proposal No. 2006SP-174G-06). The bill was approved by the Planning Commission and Planning, Zoning and Historical Committee. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from MUL and R8 to RS7.5 zoning properties located at 2517 Edge-O-Lake Drive, 2521 Edge-O-Lake Drive, and Edge-O-Lake Drive (unnumbered), approximately 250 feet east of Murfreesboro Pike (.77 acres), all of which is described herein (Proposal No. 2007Z-047U-13). The bill was approved by the Planning Commission and Planning, Zoning and Historical Committee. Ms. Wilhoite moved to defer the bill on third reading, which motion was seconded. Mr. Tygard moved to table the motion to defer, which motion was seconded and failed by a roll call vote of the Council. BILL NO. BL2007-1420
