RE: Veto of Ordinance BL2007-1372
Pursuant to section 5.04 of the Metropolitan Charter, I am hereby returning to you Ordinance BL2007-1372 with my disapproval and marked “Veto.”
Veto Message
On Ordinance BL2007-1372
Government regulation or limitation of newspapers has been abhorred in this country since before we were a nation. As a direct result, the first protection added to the Constitution contains the explicit prohibition of any law “abridging” freedom of the press. The Founders saw and understood this to be at the core of protecting and assuring the presence of liberty and democracy here. Four years before the adoption of the First Amendment Thomas Jefferson wrote “…were it left to me to decide whether we should have a government without newspapers, or newspapers without a government, I should not hesitate a moment to prefer the latter.”
As the Tennessee Press Association and our local papers have made clear, the ordinance before me is an abridgement of a free press and raises significant First Amendment issues. I cannot know how or when such issues would be decided by our courts, or how long the time or how great the cost to argue those issues would be. But we do know that every dollar spent on litigation and regulatory activity would be a dollar better spent on a teacher or police officer. And we do know the chill that would be placed upon freedoms this nation has understood since its start.
The government of Nashville will support the effort of the Downtown Partnership now working with the publishers to improve the location and appearance of their distribution. We believe this can be a model for all of our neighborhoods and other cities. And the Public Works Department will fulfill its obligation to keep our streets and sidewalks clean and safe now and in the future.
Preservation of a free press is not a simple or easy task. It is not always pretty or appealing to everyone, especially for the elected officials who are the subject of their scrutiny. The issue here is not one decided by popular opinion or the aesthetic of one day or time. This is an issue decided long ago by a newly free people who wanted always to be free and it falls to me now to assure this freedom is preserved.

information, or similar resolution that is not binding legislation during each regular meeting of the Council.”
The Rules-Confirmations-Public Elections Committee recommended approval. Mr. Crafton moved to adopt the amendment, which motion was seconded. Mr. Isabel moved to table the motion to adopt, which motion was seconded and failed by a voice vote of the Council. “No resolution requesting information or action from a Metropolitan Government department, agency,
board or commission shall be placed on the agenda unless the sponsoring Member of Council has first
requested the information or action by letter at least thirty days prior to filing the resolution. A copy
of the letter requesting the information or action must be attached to the resolution at the time it is filed.”
The Rules-Confirmations-Public Elections Committee recommended deferment. Mr. Hodge moved to defer the amendment, which motion was seconded and adopted by a voice vote of the Council.
Rule No. 25
Amended by adding the following provisions at the end of the second paragraph:
“All presentations of memorializing and congratulatory resolutions shall be limited to five (5) minutes each,
and no more than two (2) such presentations shall be allowed at any meeting of the Council. Members of
Council wishing to makes presentations of memorializing and congratulatory resolutions shall schedule the presentations with the Council Office. The Council Office shall schedule the presentations for each meeting
on a first come, first served basis.”

Fire and Building Code Appeals Board
Appointment of Mr. Mike Bearden for a term expiring March 1, 2011. Mr. Bearden will serve as the labor representative. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Neighbors moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
Planning Commission
Reappointment of Rev. Judy Cummings for a term expiring March 31, 2011. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Neighbors moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
Reappointment of Ms. Tonya Jones for a term expiring March 31, 2011. Without objection, the nomination was deferred.
Board of Zoning Appeals
Appointment of Ms. Rebecca Lyford for a term expiring February 26, 2012. Without objection, the nomination was deferred.
- RESOLUTIONS -
A resolution appropriating $25,000 in Community Development Block Grant Funds for Streetscape Improvements in the Maxwell Neighborhood Strategy Area. The Federal Grants Review Committee recommended deferment. Pursuant to Rule 23 of the Rules of Procedure of the Metropolitan Council, the resolution was deferred.
A resolution appropriating $500,000 in Community Development Block Grant funds for the installation of public street improvements of pedestrian crosswalks, related sidewalk ramps, along with associated curbing, signage, lighting and greenscape elements for the Buchanan Street Neighborhood Strategy Area. The resolution was approved by the Federal Grants Review Committee. A resolution providing amendments to the Charter of The Metropolitan Government of Nashville and Davidson County, Tennessee, in accordance with Article 19, Section 19.01, and setting forth a brief description of each amendment to be placed on the ballot. The Charter Revision Committee recommended deferment. Mr. Foster moved to defer the resolution, which motion was seconded and adopted by a voice vote of the Council.
A resolution adopting a fee schedule associated with the processing and review of certain zoning-related applications (Proposal Number 2007Z-102T). The resolution was approved by the Planning, Zoning and Historical Committee; the Budget and Finance Committee recommended deferment. Mr. Loring offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Mr. Loring moved to defer the resolution as amended, which motion was seconded. Mr. Craddock moved to suspend the rules to allow consideration of the matter at this time; Mr. Ryman objected and the rules were not suspended. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R8 to RS7.5 along 26th Avenue South, 25th Avenue South, Bernard Avenue, 24th Avenue South, Blair Boulevard, Westmoreland Drive, 30th Avenue South, 29th Avenue South, West Linden Avenue, Ashwood Avenue, Sunset Place, Westwood Avenue, Woodlawn Drive, 27th Avenue South, Natchez Trace, Belcourt Avenue, Acklen Avenue, Fairfax Avenue, Chesterfield Avenue, Marlborough Avenue, 33rd Avenue South, 32nd Avenue South, Overlook Drive, Hillside Drive, Barton Avenue, and Essex Place (282.76 acres), all of which is described herein (Proposal No. 2007Z-058U-10). The bill was approved by the Planning Commission and Planning, Zoning and Historical Committee. An ordinance amending Chapters 17.16 and 17.40 of Title 17 of the Metropolitan Code, Zoning Regulations, pertaining to the general requirements for uses permitted by special exception (SE), the requirements for the Neighborhood Landmark (NL) district, and limitations on the granting of variances, all of which is more specifically described herein (Proposal No. 2007Z-067T). The bill was approved by the Planning Commission and Planning, Zoning and Historical Committee. Ms. Evans moved to defer the bill on third reading to the second meeting in June for further review which motion was seconded and adopted by a voice vote of the Council.

An ordinance amending Section 17.12.060 of Title 17 of the Metropolitan Code, Zoning Regulations, regarding the height restrictions for single and two-family dwellings within the urban zoning overlay, all of which is more specifically described herein (Proposal No. 2007Z-068T). The bill was approved by the Planning Commission and Planning, Zoning and Historical Committee. Mr. Briley offered a substitute bill for filing and no objection was made.

- MEMORIALIZING RESOLUTIONS –
A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and enact the necessary legislation to require metal recycling businesses and scrap metal dealers to maintain a record of transaction whenever copper materials are purchased from individuals, and to require proof of identification from the seller and the origin of the materials. The resolution was approved by the Public Works Committee. A resolution requesting the Mayor, the Police Department, the Department of Public Works, and the Traffic and Parking Commission to collaborate and develop a plan to address the most dangerous intersections in Nashville. The resolution was approved by the Public Works and Traffic and Parking Committees; the Public Safety-Beer and Regulated Beverages Committee approved the resolution with an amendment. Without objection, the rules were suspended to allow an amendment to the resolution. Ms. Pepper offered Amendment No.1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. The resolution was approved by the Public Safety-Beer and Regulated Beverages Committee with an amendment. Without objection, the rules were suspended to allow an amendment to the resolution. Ms. Pepper offered Amendment No.1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. A resolution requesting the Industrial Development Board to consider the use of tax increment financing to promote economic development and commercial growth of the Highway 70 corridor in Bellevue and the Hickory Hollow Mall area. The resolution was approved by the Budget and Finance Committee. Mr. Crafton requested suspension of the rules for consideration of one (1) additional late resolution; Mr. Wallace objected and the rules were not suspended.
