Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilmember Diane Neighbors.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Dozier, Neighbors, Tucker, Briley, Dread, Gilmore, Isabel, Hunt, Craddock, Murray, Jameson, Cole, Hart, Forkum, Ryman, Brown, Gotto, Burch, White, Loring, Page, Greer, Pepper, Wallace, Walls, Whitmore, Crafton, Evans, Summers, Shulman, Adkins, Foster, Wilhoite, Hodge, Toler, Coleman, Duvall, Williams, Tygard and President Gentry (40); Absent: Alexander (1).

The Minutes of the regular meeting of March 20, 2007, were approved.

- MOTION TO RECONSIDER -

SUBSTITUTE BILL NO. BL2007-1334

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6 to RS3.75 (10.64 acres), from R6 to RS5 (44.63 acres), and from R6 to RS10 zoning (10.64 acres) various properties located south of Albion Street on 35th Avenue North, 34th Avenue North, 33rd Avenue North, 32nd Avenue North, 31st Avenue North, 30th Avenue North, 29th Avenue North, Clare Avenue, Batavia Street, Clifton Avenue, Torbett Street, and Indiana Avenue (59.09 acres), all of which is described herein (Proposal No. 2007Z-024U-08). The bill was approved by the Planning Commission and Planning, Zoning and Historical Committee. - COMMITTEE REPORTS ON MATTERS OTHER THAN LEGISLATION -

Rule No. 8.
Amending by adding the following new paragraph:

“When a Member of Council has requested the Council Office or the Planning Commission staff to prepare a resolution or ordinance on a specific subject matter, no other Member of Council may sign the resolution or ordinance without the written consent of the primary sponsor. The foregoing provisions shall not prevent another Member of Council from filing similar legislation.”

The Rules-Confirmations-Public Elections Committee recommended indefinite deferment of the amendment. Mr. Summers moved to defer the proposed amendment indefinitely, which motion was seconded and adopted by a voice vote of the Council.

Rule No. 32
Amending by adding the following new paragraph:

“The foregoing provision shall not prohibit a Member of Council from first making a parliamentary inquiry prior to making a motion to table or a motion for the previous question.”

The Rules-Confirmations-Public Elections Committee recommended indefinite deferment of the amendment. Mr. Summers moved to defer the proposed amendment indefinitely, which motion was seconded and adopted by a voice vote of the Council.

Rule No. 8.
Amending by adding the following new paragraph:

“Members of Council shall be limited to filing no more than one memorializing resolution, resolution requesting
information, or similar resolution that is not binding legislation during each quarter of the calendar year.”

The Rules-Confirmations-Public Elections Committee recommended deferment of the amendment. Mr. Crafton moved to defer the proposed amendment, which motion was seconded and adopted by a voice vote of the Council.

Rule No. 8.
Amending by adding the following new paragraph:

“Once a Member of Council has signed a proposed resolution or ordinance as a sponsor, no other Member
of Council may remove the sponsor’s signature from the legislation without his/her written consent.”

The Rules-Confirmations-Public Elections Committee recommended indefinite deferment of the amendment. Mr. Tygard moved to defer the proposed amendment indefinitely, which motion was seconded and adopted by a voice vote of the Council.

The following proposed amendments to the Rules of Procedure of the Metropolitan Council were distributed and will be considered at the next regular meeting of Council:

Adding the following new rule:

“When, at a Council meeting, the Council receives a message from the Mayor that the Mayor has vetoed
an ordinance passed upon three (3) readings by the Council or a resolution passed upon one (1) reading
of the Council, no motion to override such veto shall be in order during such meeting. Neither shall a
motion to override such a veto be in order during the first Council meeting of an odd month.
When a motion to override a mayoral veto is made and seconded, such motion shall be a debatable motion
and shall not be subject to a motion to table. No motion calling the previous question shall be in order until
the proponents and opponents shall have been allowed a total of thirty (30) minutes of debate except that
such a motion shall be in order if, before the mandated period of debate is concluded, all members desiring
to speak have spoken and no other member seeks recognition to speak.”

Rule No. 25
Amending by deleting the last three sentences of the Rule and substituting in lieu thereof the following new sentences:

“Announcements, extraordinary matters, and the presentation of memorializing and congratulatory resolutions
shall be held thirty (30) minutes prior to all regularly scheduled Council meetings. The president pro tempore
or his/her designee shall preside over such matters. No presentation of memorializing or congratulatory
resolutions shall be conducted during a regularly scheduled meeting of the Council.”

- ELECTIONS AND CONFIRMATIONS -

Board of Public Education

The President called for an election to fill a vacancy on the Metropolitan Board of Public Education from School District 3 as required by law. The only nomination submitted by the filing deadline: Mr. Mark North. Ms. Neighbors reported that the Rules-Confirmations-Public Elections had interviewed the nominee and found that he meets the required qualifications for the office. Mr. Ryman moved to elect Mr. North by acclamation, which motion seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2007-1821

A resolution accepting a grant from the Tennessee Department of Health to the Metropolitan Department of Health to provide sexually transmitted disease services and HIV/AIDS prevention and surveillance. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees. RESOLUTION NO. RS2007-1846

A resolution providing amendments to the Charter of The Metropolitan Government of Nashville and Davidson County, Tennessee, in accordance with Article 19, Section 19.01, and setting forth a brief description of each amendment to be placed on the ballot. The Charter Revision Committee recommended deferment. Mr. Foster moved to defer the resolution to the first meeting in June, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2007-1847

A resolution supplementing and amending Resolution No. RS2007-1811 of The Metropolitan Government of Nashville and Davidson County and awarding the sale of the Metropolitan Government’s General Obligation Refunding Bonds, Series 2007A. The resolution was approved by the Budget and Finance Committee.

The Clerk reported that the following bids were received on this date for sale of $200,575,000 General Obligation Refunding Bonds, Series 2007A, of The Metropolitan Government of Nashville and Davidson County.

A resolution approving an application for an Access to Artistic Excellence grant from the National Endowment for the Arts to The Metropolitan Government of Nashville and Davidson County. A resolution accepting a grant from the March of Dimes Birth Defects Foundation to the Metropolitan Government of Nashville and Davidson County, by and through the Board of Health, for a community based screening and education program targeting teens at risk of pregnancy. BILL NO. BL2007-1382

An ordinance amending Title 2 of the Metropolitan Code of Laws to implement standards of conduct for Metropolitan Government elected officials, employees, and members of boards and commissions. Mr. Ryman moved pass the bill on first reading, which motion was seconded. Mr. Summers offered Amendment No.1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Mr. Ryman moved to pass the bill on first reading as amended and refer the bill to the Rules-Confirmations-Public Elections Committee, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2007-1398

The Budget Ordinance of The Metropolitan Government of Nashville and Davidson County, Tennessee for Fiscal Year 2008. Mr. Ryman moved pass the bill on first reading, refer the bill to the Budget and Finance Committee and defer the bill to the first meeting in June, which motion was second and adopted by a voice vote of the Council.

BILL NO. BL2007-1399

An ordinance establishing the tax levy in the General Services District for the fiscal year 2007-2008, and declaring the amount required for the annual operating budget of the Urban Services District, pursuant to Section 6.07 of the Metropolitan Charter. Mr. Ryman moved pass the bill on first reading, refer the bill to the Budget and Finance Committee and defer the bill to the first meeting in June, which motion was second and adopted by a voice vote of the Council.

BILL NO. BL2007-1400

An ordinance amending Chapter 11.26 of the Metropolitan Code to require property owners to remove graffiti from their property. Upon motion duly seconded, the bill passed first reading and was referred to the Codes, Fair and Farmers Market and Public Safety-Beer and Regulated Beverages Committees by a voice vote of the Council.
BILL NO. BL2007-1401

An ordinance amending Section 16.24.330 of the Metropolitan Code pertaining to the parking and storage of antique motor vehicles. Upon motion duly seconded, the bill passed first reading and was referred to the Codes, Fair and Farmers Market Committee by a voice vote of the Council.

BILL NO. BL2007-1402

An ordinance amending Chapter 6.72 of the Metropolitan Code to require drivers of vehicles for hire to provide proof of CPR certification prior to obtaining a driver’s permit from the Transportation Licensing Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Public Safety-Beer and Regulated Beverages Committee by a voice vote of the Council.

BILL NO. BL2007-1403

An ordinance authorizing the Metropolitan Government to participate with Burkitt Place Development LLC, to provide public sewer service in Davidson and Williamson County to Burkitt Place Phase 2-C, Project No. 06-SL-68. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Works Committees by a voice vote of the Council.

BILL NO. BL2007-1404

An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, by abandoning a portion of the right-of-way for Alley #566 from Warren Street to Alley #565 (Proposal No. 2006M-019U-09). The bill was approved by the Planning Commission and Traffic and Parking Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2007-1405

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a to SP zoning, property located at 8811 Newsom Station Road and Newsom Station Road (unnumbered), approximately 1700 feet northwest of Coley Davis Road (141.4 acres), to permit 16 two-family units, 35 townhome units, and 197 single-family homes, for a total of 248 units, all of which is described herein (Proposal No. 2006SP-093G-06). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2007-1406

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending a Planned Unit Development district located at 8118 B Sawyer Brown Road, approximately 350 feet south of Esterbrook Drive, to permit a 14,200 square foot addition and 20 additional units for an existing Assisted Living Unit, all of which is more particularly described herein (Proposal No. 98P-003G-06). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2007-1407

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending the adopted Belmont-Hillsboro Neighborhood Conservation Overlay to include various properties located along Ashwood Avenue, Wildwood Avenue, Brightwood Avenue, Dallas Avenue, Paris Avenue, Cedar Lane, and Clayton Avenue, all of which is described herein (Proposal No. 2007Z-059U-10). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2007-1408

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by canceling a Planned Unit Development district located at 6640 Nolensville Pike, approximately 700 feet south of Autumn Oaks Drive, approved for a 16 unit motel and a 3,000 square foot restaurant (3.36 acres), all of which is described herein (Proposal No. 111-83-G-12). An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS15 to RM20 zoning properties located at 7312, 7316 and 7320 Highway 70 South, approximately 1,015 feet east of Cross Timbers Drive (1.69 acres), all of which is described herein (Proposal Nos. 2006Z-175G-06 and 2007Z-036G-06). The bill was disapproved by the Planning Commission and approved by the Planning, Zoning and Historical Committee. Mr. Crafton moved to defer the bill indefinitely, the bill being requested by Thomas and Cherri Teachout, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2007-1340

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending a portion of the Planned Unit Development district located at 7727, 7739, 7745 Old Harding Pike, 8020, 8024, 8036 Highway 100, Old Harding Pike (unnumbered), and Highway 100 (unnumbered), previously approved for 74 townhomes, 26,700 square feet of office/library, 87,900 square feet of retail/restaurant/bank uses, and to amend by allowing for 101,677 square feet of retail/restaurant/bank uses, 20,000 square feet of office, and to allow for a new ingress/egress along Highway 100, all of which is more particularly described herein (Proposal No. 2005P-008G-06). The bill was approved by the Planning Commission and Planning, Zoning and Historical Committee. Mr. Tygard offered Amendment No.1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Mr. Tygard moved to pass the bill on third reading as amended, which motion was seconded and failed by the following vote: “Ayes” Dozier, Neighbors, Dread, Gilmore, Hunt, Craddock, Murray, Ryman, Brown, Gotto, Loring, Pepper, Walls, Whitmore, Crafton, Evans, Shulman, Adkins, Foster, Wilhoite, Hodge, Toler, Coleman, Duvall, Williams, Tygard (26); “Noes” (0) “Abstaining” Briley, Jameson, Greer (3).

BILL NO. BL2007-1353

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R20 to SP zoning property located at Sawyer Brown Road (unnumbered), opposite Williamsburg Court (7.8 acres), to permit the development of 31 townhomes, all of which is described herein (Proposal No. 2007SP-007G-06). The bill was approved by the Planning Commission and Planning, Zoning and Historical Committee. Mr. Crafton moved to defer the bill to the second meeting in May, the bill being requested by Dale and Associates, which motion was seconded and adopted by a voice vote of the Council

BILL NO. BL2007-1366

An ordinance amending Section 17.32.050 of Title 17 of the Metropolitan Code, Zoning Regulations, to allow signs with lights or illuminations that flash, move, rotate, scintillate, blink, flicker or vary in intensity or color within the CL zoning district, all of which is more specifically described herein (Proposal No. 2007Z-033T). The bill was disapproved by the Planning Commission and approved by the Planning, Zoning and Historical Committee. Mr. Brown moved to defer the bill on third reading, which motion was seconded and adopted by a voice vote of the Council.

An ordinance authorizing the Metropolitan Government to enter into Utility Relocation Contract No. 6912, with the State of Tennessee, Department of Transportation, Project No. 19009-2178-44, to relocate certain facilities, located on the public highway right-of-way, I-65, from Wedgewood Avenue to near Craighead Avenue (Area 120-TYPE II Noise Walls), located in Davidson County. The bill was approved by the Budget and Finance and Public Works Committees.
