Metropolitan Council Meeting
Tuesday, December 16, 2003


The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan City Hall.

The invocation was offered by Councilmember Brenda Gilmore.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Dozier, Neighbors, Tucker, Briley, Dread, Gilmore, Isabel, Hughes, Craddock, Murray, Jameson, Cole, Forkum, Ryman, Brown, Gotto, Burch, White, Loring, McClendon, Greer, Hausser, Wallace, Walls, Whitmore, Crafton, Whitson, Summers, Shulman, Adkins, Foster, Alexander, Wilhoite, Kerstetter, Toler, Coleman, Bradley, Williams, Tygard and President Gentry (40); Absent: Hart (1).

The Minutes of the regular meeting of December 2, 2003 were approved.

The President announced vacancies in the offices of public administrator, public guardian, and public trustee for four-year terms, which appointments are made by the Metropolitan Council pursuant to state law. Nominations must be filed with the Metropolitan Clerk not later than 4:00 p.m. on Tuesday, December 23, 2003, and an election for the positions will be conducted at the meeting of January 20, 2004, in accordance with Temporary Council Rule Nos. 41 and 43.


- RESOLUTIONS -

RESOLUTION NO. RS2003-30

A resolution requesting the Metropolitan Police Department to consider designating a special police unit called “Safe Passage” to protect elementary and middle school children walking to school or to the bus stop to minimize the incidence of kidnapping and abduction, and to study the feasibility of using officers as they change shifts for this program to minimize costs. The resolution was approved by the Education and Public Safety-Beer, Wine and Whiskey Committees. Ms. Gilmore moved to defer the resolution indefinitely, which motion was seconded and adopted by a voice vote of the Council.


RESOLUTION NO. RS2003-59

A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and enact enabling legislation that would allow the Metropolitan Government to create a Community Environmental Court. The Codes, Fair and Farmers Market Committee approved the resolution with an amendment. Ms. Gilmore offered Amendment No. 1 and moved for its adoption, which motion was seconded. After discussion the motion was withdrawn. Ms. Gilmore moved to adopt the resolution, which motion was seconded. After further discussion, Mr. Adkins called for the previous question, which motion was seconded and adopted by a voice vote of the Council. RESOLUTION NO. RS2003-88

A resolution requesting the Metropolitan Police Department to enforce the Metropolitan Code provisions prohibiting the collection of garbage during certain hours. The Public Safety-Beer, Wine and Whiskey Committee recommended deferment. Mr. Wallace moved to defer the resolution, which motion was seconded and adopted by a voice vote of the Council.


RESOLUTION NO. RS2003-112

A resolution requesting the Nashville Fire Department to take the necessary steps to secure funding for and purchase a seismic measurement device to monitor blasting at rock quarries. The Public Safety-Beer, Wine and Whiskey Committee recommended deferment. Mr. Isabel moved to defer the resolution, which motion was seconded and adopted by a voice vote of the Council.


RESOLUTION NO. RS2003-113

A resolution establishing a citizens’ task force to review Article II of Chapter 2.04 of the Metropolitan Code which imposes certain standards of ethical conduct and to make recommendations of improvements to Article II of Chapter 2.04 of the Metropolitan Code to the Metropolitan Council. The Rules-Confirmations-Public Elections Committee recommended deferment. Mr. Briley moved to defer the resolution, which motion was seconded and adopted by a voice vote of the Council.


RESOLUTION NO. RS2003-114

A resolution approving application for and acceptance of a grant from the Tennessee Emergency Management Agency, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Mayor’s Office of Emergency Management to develop a program to train emergency responders to respond to a terrorist attack. The Budget and Finance and Public Safety-Beer, Wine and Whiskey Committees approved the resolution with an amendment. Mr. Dread offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. RESOLUTION NO. RS2003-115

A resolution approving application for and acceptance of a grant from the Tennessee Emergency Management Agency, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Mayor’s Office of Emergency Management to purchase domestic preparedness public safety equipment. The Budget and Finance and Public Safety-Beer, Wine and Whiskey Committees approved the resolution with an amendment. Mr. Dread offered Amendment No. 1 and moved for its adoption which motion was seconded and adopted by a voice vote of the Council. A resolution approving a grant agreement by and between the Tennessee Department of Health, and the Metropolitan Government, acting by and through the Metropolitan Health Department, in an amount not to exceed $17,000 for improving cardiovascular health among at-risk populations in Davidson County. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees. RESOLUTION NO. RS2003-120

A resolution approving a grant not to exceed $250,000 from the Rockefeller Foundation to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Career Advancement Center (NCAC), to improve the capacity of Nashville’s non-profits to provide workforce development services to poor and disenfranchised job seekers, and appropriating those funds and $150,000 in local matching funds to the appropriate funds for this purpose. The resolution was approved by the Budget and Finance and Personnel-Public Information-Human Relations- Housing Committees. RESOLUTION NO. RS2003-121

A resolution authorizing the Metropolitan Department of Law to compromise and settle the final claim of Billy R. Johnson against The Metropolitan Government of Nashville and Davidson County for an amount not to exceed $25,841.45 and directing that this amount be paid from the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee. An ordinance amending Section 7.16.030 of the Metropolitan Code of Laws to allow liquor sales at retail locations on collector streets provided that the location is on a lot in the MUG zoning district. Upon motion duly seconded, the bill passed first reading and was referred to the Public Safety-Beer, Wine and Whiskey Committee by a voice vote of the Council.


BILL NO. BL2003-114

An ordinance approving an increase in the basic rate charged by the division of emergency ambulance and rescue service for the transportation of patients to hospitals to $650.00 with an additional charge of $5.00 per mile effective January 1, 2004. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Safety-Beer, Wine and Whiskey Committees by a voice vote of the Council.


BILL NO. BL2003-115

An ordinance approving a practicum affiliation agreement between The Metropolitan Government of Nashville and Davidson County, acting through the Metropolitan Social Services Commission and the Nashville State Technical Community College to provide clinical experience for students enrolled the Early Childhood Education program at Nashville State Technical Community College. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Health, Hospitals, and Social Services Committees by a voice vote of the Council.


BILL NO. BL2003-116

An ordinance authorizing the acquisition of property by negotiation or condemnation for the addition of a turn lane to be added just North of the Intersection at Edmondson Pike and Old Hickory Boulevard, Project No. 03-R-08 (Proposal No. 2004M-002U-12). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission, Budget and Finance, Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.


BILL NO. BL2003-117

An ordinance authorizing the acquisition of property by negotiation or condemnation for the purpose of acquiring water mains, sanitary sewers, reservoirs, and stormwater easements for use in public projects of the Metropolitan Government and specifically with relation to Project No. 03-D-0417, 1107 Woodvale Dr., Map 131-04, Parcel 152 Public Utility Drainage Easement, Stormwater (Proposal No.2003M-102U-10). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance, Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2003-20

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R15 district to RS10 district property at Hobson Pike (unnumbered), at the south terminus of Smith Springs Parkway, (85 acres), all of which is more particularly described herein (Proposal No. 2003Z-117G-13). The bill was approved by the Planning Commission and Planning, Zoning and Historical Committee. Mr. Bradley moved to disapprove the bill on second reading, which motion was seconded and adopted by a unanimous vote of the Council.


BILL NO. BL2003-59

An ordinance amending Section 7.16.030 of the Metropolitan Code of Laws to allow liquor sales at retail locations on collector streets. Mr. Dread moved to withdraw the bill, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2003-94

An ordinance amending Section 10.20.300 of the Metropolitan Code of Laws to prohibit the collection of garbage between the hours of eleven p.m. and seven a.m., and to include a permit forfeiture provision for multiple violations of the hours of collection restriction. The Public Works Committee recommended deferment. Mr. Wallace moved to defer the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.


BILL NO. BL2003-95

An ordinance amending Article I of Chapter 2.04 of the Metropolitan Code of Laws to require that notice of the enactment of ordinances amending the Metropolitan Code be posted by government access television on the government access channel. The Rules-Confirmations-Public Elections Committee recommended deferment. Mr. Shulman moved to defer the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.


BILL NO. BL2003-96

An ordinance amending the Metropolitan Code of Laws to designate the responsibility of operating all cemeteries owned by the Metropolitan Government to the Metropolitan Historical Commission and to designate the responsibility to the Historical Commission to approve markers and stones, prior to installation, in the cemeteries owned by the Metropolitan Government to ensure that they are in keeping with the historic nature of the cemetery. The bill was approved by the Planning, Zoning and Historical Committee. Mr. Shulman moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, by closing a portion of Lawrence Avenue (Proposal No. 2003M-115U-04). An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, by renaming a portion of 37th Avenue North, between Georgia Avenue and Indiana Avenue, to Elizabeth Jordan Street (Proposal No. 2003M-113U-08). An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, by naming alley # 2090 and part of alley # 2089, between Spring Valley Road and Alley # 2090 to "Spring Valley Lane" (Proposal No. 2003M-116U-14). An ordinance authorizing the Metropolitan Government to enter into a Participation Agreement with Beazer Homes Corporation d/b/a Phillips Builders, to provide public sewer service in Ballenger Farms, Phase One, Project No. 03-SL-179, in Williamson County. The bill was approved by the Budget and Finance and Public Works Committees. An ordinance abandoning a sewer easement located at 254 Spence Lane, Map 94-15, Parcel 8, of Project 03-SG-143. (Proposal No. 2003M-103U-14). An ordinance authorizing the acquisition of property by negotiation or condemnation for the purpose of acquiring water mains, sanitary sewers, reservoirs, and stormwater easements for use in public projects of the Metropolitan Government and specifically with relation to Project No. 02-SL-129, Rural Hill Townhouses, and to authorize the Director of Water and Sewage Services to execute an agreement with Alliance Constructors, Incorporated, to pay all easement costs (Proposal No. 2002M-117U-13).
