Metropolitan Council Meeting
Tuesday, December 2, 2003


The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metro City Hall.

The invocation was offered by Rev. Enoch Fuzz.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The Minutes of the meeting of November 18, 2003, were approved with one amendment to correct the roll call vote on the Gordon Larkins appointment to the Beer Permit Board to state that Mr. Walls rather than Mr. Wallace voted “Aye.”

Community Corrections Advisory Board
Reappointment of Rev. Mary Friskics-Warren for a term expiring November 9, 2005. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Bradley moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Ms. Mary Vowels for a term expiring August 31, 2005. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Bradley moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

BILL NO. BL2003-36

An ordinance amending and extending the License and Franchise of Nashville Gas Company (formerly Nashville Gas and Heating Company), a Tennessee corporation, for an additional period. Ms. Gilmore requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill, and no one came forward to be heard. The President declared the public hearing closed. A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and enact the necessary legislation to require that the requirements for a license issued by the Tennessee Alcoholic Beverage Commission to establishments located in Davidson County for sale and consumption of alcoholic beverages comport with the minimum distance requirements of the Metropolitan Government for the issuance of on-sale beer permits. RESOLUTION NO. RS2003-46

A resolution requesting the Metropolitan Planning Commission to evaluate the current community education standards in the Zoning Code, and to recommend any modifications necessary to ensure such facilities receive appropriate review. A resolution requesting the Federal Communications Commission, the President of the United States George W. Bush, Senate Majority Leader Bill Frist, the United States Senate, Speaker of the House J. Dennis Hastert, the United States House of Representatives, and the Tennessee Congressional Delegation to examine the feasibility of requiring all wireless telecommunication providers to charge customers only for the amount of time per call actually used and allow customers to carryover unused minutes. The resolution was deferred by the Public Safety-Beer, Wine and Whiskey Committee. Mr. Wallace moved to defer the resolution indefinitely, which motion was seconded and adopted by a voice vote of the Council.


RESOLUTION NO. RS2003-65

A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and enact the necessary legislation, to the extent Constitutionally permissible, to allow local law enforcement agencies to seize vehicles used for illegal dumping. A resolution requesting the Governor and the Davidson County Delegation to the Tennessee General Assembly to support and adopt legislation to increase the state gasoline tax and to provide a means for local governments to share in the gasoline tax for the purposes of funding education and fire and police protection. A resolution requesting the Metropolitan Police Department to enforce the Metropolitan Code provisions prohibiting the collection of garbage during certain hours. The Public Safety-Beer, Wine and Whiskey Committee recommended deferment. RESOLUTION NO. RS2003-89

A resolution requesting the Metropolitan Nashville Airport Authority to examine the number and location of security cameras at the Nashville International Airport, and to install additional cameras where necessary. The Transportation and Aviation Committee recommended deferment. Ms. Wilhoite moved to defer the resolution to the second meeting in January 2004, which motion was seconded and adopted by a voice vote of the Council.
