The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metro City Hall.
The invocation was offered by Mr. Jesse Tucker, husband of Councilmember Tucker.
The Metropolitan Council gave the pledge of allegiance to the American Flag.

- ELECTIONS AND CONFIRMATIONS -
General Sessions Judgeship
The President called for an election to fill a General Sessions Court judgeship as required by law. Nominations previously made were: Ana L. Escobar Burchwell, Daniel B. Eisenstein, Robert Ray Galbreath, Lawrence H. Hart, Lynda F. Jones, Andrei Ellen Lee, Rosemary Ducklo Sexton, Richard L. Tennent, Dianne Turner, and Paul J. Walwyn. Candidates Burchwell, Hart, Jones and Sexton withdrew their names from consideration prior to the meeting. Ms. McClendon, Chair of the Rules-Confirmations-Public Elections Committee, reported that the Committee had interviewed and found all candidates qualified to serve. There being no candidate receiving a majority vote, the President called for a second ballot between candidates Lee and Turner. The President announced that Mr. Hampton had withdrawn his name from consideration. Auditorium Commission
Appointment of Ms. Abby Trotter to the Auditorium Commission for a term expiring
June 30, 2006. The Rules-Confirmations-Public Elections Committee recommended
the appointment and Ms. McClendon moved for confirmation, which motion was
seconded and adopted by a unanimous vote of the Council.
Electrical Examiners and Appeals Board
Reappointment of Mr. James Shaw to the Electrical Examiners and Appeals Board
for a term expiring October 19, 2007.
The Rules-Confirmations-Public Elections Committee recommended the appointment
and Ms. McClendon moved for confirmation, which motion was seconded and adopted
by a unanimous vote of the Council.
Appointment of Ms. Pamela Wyatt to the Electrical Examiners and Appeals Board
for a term expiring October 19, 2007.
The Rules-Confirmations-Public Elections Committee recommended the appointment
and Ms. McClendon moved for confirmation, which motion was seconded and adopted
by a unanimous vote of the Council.
Hospital Authority
Reappointment of Mr. Waverly Crenshaw to the Hospital Authority for a term
expiring November 4, 2008. The Rules-Confirmations-Public Elections Committee
recommended the appointment and Ms. McClendon moved for confirmation, which
motion was seconded and adopted by a unanimous vote of the Council.
Human Relations Commission
Appointment of Mr. Nelson Andrews to the Human Relations Commission for a term
expiring April 18, 2004. The Rules-Confirmations-Public Elections Committee
recommended the appointment and Ms. McClendon moved for confirmation, which
motion was seconded and adopted by a unanimous vote of the Council.
Stormwater Management Committee
Reappointment of Mr. Thomas Allen to the Stormwater Management Committee for
a term expiring October 31, 2007. The Rules-Confirmations-Public Elections
Committee recommended the appointment and Ms. McClendon moved for confirmation,
which motion was seconded and adopted by a unanimous vote of the Council.
Appointment of Mr. Tracey Kinslow to the Stormwater Management Committee for a term expiring October 31, 2007. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. McClendon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by making applicable to property abutting the northeast corner of 5th Avenue North and Madison Street, classified MUN, (.29 acres), the provisions of a Planned Unit Development District, to permit a restaurant within the Mixed Use Development to have an exemption from the minimum distance requirements included in the beer provisions of the Metro Code, (Proposal No. 2003P-012U-08). The bill was approved by the Planning Commission. Mr. Wallace requested a hearing from the public on this bill which had been previously advertised. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning
Ordinance of The Metropolitan Government of Nashville and Davidson County,
by amending Section 17.24.050 by exempting the tree density requirements from
loading areas or tractor trailer staging, loading and parking areas, all of
which is more particularly described herein (Proposal No. 2003Z-013T). Mr.
Adkins moved to defer the bill to the January 2004 public hearing, which motion
was seconded and adopted by a voice vote of the Council.
BILL NO. BL2003-26
An ordinance amending various sections of Title 17 of the Metropolitan Code, Zoning Regulations relative to requiring a planned unit development overlay or an urban design overlay for properties disturbing, altering, modifying, changing, or encroaching on twenty percent or more of the natural floodplain and/or floodway areas required to be preserved (Proposal No. 2003Z-010T). The bill was approved by the Planning Commission. Mr. Summers moved to defer the bill indefinitely which motion was seconded and adopted by a voice vote of the Council.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R8 district to RS7.5 district and R10 district to RS10 district various properties located east of Nolensville Pike, south of Thompson Lane and west of I-24, (640.81 acres), all of which is described herein (Proposal No. 2003Z-103U-11). The bill was approved by the Planning Commission. Ms. McClendon requested a hearing from the public on this bill which had been previously advertised. - BILLS ON INTRODUCTION AND FIRST READING -
An ordinance amending Chapter 10.52 of the Metropolitan Code of Laws to limit the hours of operation for quarries and mines from nine o’clock (9:00) a.m. to three o’clock (3:00) p.m. Monday through Friday. Mr. Isabel moved to withdraw the bill, which motion was seconded and adopted by a voice vote of the Council.
An ordinance readopting the Code of The Metropolitan Government of Nashville and Davidson County, Tennessee, prepared by Matthew Bender & Company, Inc., including supplemental and replacement pages thereof, containing certain ordinances of a general and permanent nature enacted on or before August 19, 2003. Upon motion duly seconded, the bill passed first reading and was referred to the Rules-Confirmations-Public Elections Committee by a voice vote of the Council.
An ordinance establishing a program for the purpose of providing assistance to low-income elderly residents of the Metropolitan Government for the fiscal year 2003-2004. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.
An ordinance amending Section 2.56.400 of the Metropolitan Code of Laws by changing the name of Justice Information System to “Justice Integration Services.” Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.
An ordinance approving a contract for services performed by The Metropolitan Government of Nashville and Davidson County for the Emergency Communications District for Nashville, Davidson County, for reimbursement of $42,711.00. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance, Public Works and Public Safety-Beer, Wine and Whiskey Committees by a voice vote of the Council.
An ordinance authorizing RAM Partners, LLC. to construct, install, and maintain a sign on the public right-of-way located at 100 Riverchase Boulevard, (Proposal No. 2003M-108G-04). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works, Traffic and Parking, and Planning, Zoning and Historical Committees by a voice vote of the Council.
An ordinance to abandon and relocate an existing 8” sanitary sewer line and easement located on Map 117-15, Parcels 111-113 of Project No. 03-SL-039, Observatory Dr., Green Hills Subdivision, Phase 1 (Proposal No. 2003M-090U-10). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.
An ordinance authorizing the acquisition of property by negotiation or condemnation for the purpose of acquiring water mains, sanitary sewers, reservoirs, and stormwater easements for use in public projects of the Metropolitan Government and specifically with relation to Project No. 03-D-0404, Lauderdale Road Public Utility Drainage Easement, Stormwater (Proposal No.2003M-078U-10). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance, Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.
An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, by closing a portion of Argyle Avenue and changing the name of portions of Argyle Avenue to East and West Argyle Avenue (Proposal No. 2003M-100U-10). The bill was disapproved by the Planning Commission and the Emergency Communication District Board. Upon motion duly seconded, the bill passed first reading and was referred to the Traffic and Parking Commission, Public Works, Traffic and Parking and Planning, Zoning and Historical Committees by a voice vote of the Council.
An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for the Metropolitan Government of Nashville and Davidson County, by abandoning Alley #1065, located between the properties of 1338 and 1324 Brick Church Pike, (Proposal No. 2003M-099U-03). An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R10 and OL districts to CS district properties at 1331 Jansing Drive and Jansing Drive (unnumbered), approximately 400 feet south of Antioch Pike (3.58 acres), all of which is more particularly described herein (Proposal No. 2003Z-096U-13). The bill was disapproved by the Planning Commission. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a district to RS7.5 district property at 12746 Old Hickory Boulevard, north of Logistics Way, (5.3 acres), all of which is more particularly described herein (Proposal No. 2003Z-115G-13). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.
