Metropolitan Council Meeting
Tuesday, June 4, 2003


The Metropolitan Council met in special session on this date at 6:30 p.m. in the Metro City Hall.

The invocation was offered by Councilmember Phil Ponder.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Ferrell, Waters, Briley, Tucker, Black, Majors, Hall, Beehan, Campbell, Hart, Dillard, Balthrop, Brown, Ponder, Derryberry, Stanley, Loring, McClendon, Greer, Hausser, Wallace, Hand, Bogen, Summers, Shulman, Sontany, Holloway, Kerstetter, Jenkins, Williams, Tygard, and President Gentry (32); Absent: Dread, Gilmore, Nollner, Haddox, Whitmore, Alexander, Knoch and Turner (8).

Members of the Metropolitan County Council

Ladies and Gentlemen:

Pursuant to Section 3.04 of the Charter of the Metropolitan Government of Nashville and Davidson County, I am calling a Special Meeting of the Council to be held on Wednesday, June 4, 2003, at 6:30 p.m. in the Metropolitan Council Chambers.

The purpose of this meeting is to consider several zoning ordinances on public hearing and second reading that appeared on the agenda for our regular meeting of Tuesday, May 6, 2003, but were not considered due to our premature adjournment for lack of a quorum. The following zoning ordinances are to be considered at this Special Meeting:

Ordinance No. BL2003-1396 (Wallace)
Ordinance No. BL2003-1397 (Wallace)
Ordinance No. BL2003-1398 (Wallace
Ordinance No. BL2003-1399 (Summers)

No other matters shall be considered at this meeting, and I encourage your attendance.

- BILLS ON PUBLIC HEARING -

BILL NO. BL2003-1396

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RM20 district to OR40 district properties at 1033, 1035, 1037, 1039, and 1041 14th Avenue North, and 1404, 1406, 1408 and 1408 1 Meharry Boulevard, at the intersection of Meharry Boulevard and 14th Avenue North, (.98 acres), all of which is more particularly described herein (Proposal No. 2003Z-018U-08). The bill was approved by the Planning Commission. Mr. Wallace requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill, and no one came forward to be heard. The President declared the public hearing closed. Mr. Wallace moved to pass the bill on second reading and refer it to the Planning, Zoning and Historical Committee, which motion was seconded and adopted by a voice vote of the Council.


BILL NO. BL2003-1397

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RM20 district to OR40 district properties at 1025, 1027, 1029, and 1031 14th Avenue North, and 1311 and 1313 Meharry Boulevard, at the intersection of Meharry Boulevard and 14th Avenue North, (.82 acres), all of which is more particularly described herein (Proposal No. 2003Z-018U-08). The bill was disapproved by the Planning Commission. Mr. Wallace requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill, and a citizen was heard in favor of passage of the bill. The President declared the public hearing closed. Mr. Wallace moved to pass the bill on second reading and refer it to the Planning, Zoning and Historical Committee, which motion was seconded and adopted by a voice vote of the Council.


BILL NO. BL2003-1398

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CS district to MUL district properties at 1401 and 1405 Jefferson Street, at the intersection of 14th Avenue North and Jefferson Street, (.36 acres), all of which is more particularly described herein (Proposal No. 2003Z-018U-08). The bill was approved by the Planning Commission. Mr. Wallace requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill, and no one came forward to be heard. The President declared the public hearing closed. Mr. Wallace moved to pass the bill on second reading and refer it to the Planning, Zoning and Historical Committee, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2003-1399

An ordinance to amend various sections of Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County (2003Z-009T), all of which is more particularly described herein. The bill was approved by the Planning Commission. Mr. Summers requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill, and no one came forward to be heard. The President declared the public hearing closed. Mr. Summers moved to pass the bill on second reading, to refer the bill to the Planning, Zoning and Historical Committee and defer the bill for two meetings, which motion was seconded and adopted by a voice vote of the Council.


Upon motion duly seconded, the meeting was adjourned.
