Metropolitan Council Meeting
Tuesday, September 17, 2002


The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Reverend Denman Frazer of Andrew Price Memorial United Methodist Church.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

- ELECTIONS AND CONFIRMATIONS -

President Pro Tem
The President called for nominations for President Pro Tem of the Metropolitan Council for a one-year term expiring August 31, 2003. Ms. Sontany nominated Mr. Majors, which motion was seconded; Mr. Jenkins nominated Mr. Ponder, which motion was seconded. The vote was taken and recorded as follows: Majors: Ferrell, Waters, Briley, Tucker, Black, Majors, Hall, Campbell, Derryberry, Loring, Greer, Whitmore, Summers, Sontany (14); Ponder: Gilmore, Nollner, Beehan, Hart, Dillard, Balthrop, Brown, Ponder, Stanley, Hausser, Wallace, Haddox, Hand, Bogen, Shulman, Arriola, Kerstetter, Jenkins, Turner, Williams (20); Abstaining: Alexander. The President declared that Mr. Ponder was elected President Pro Tem for a one-year term.

Agricultural Extension Board
Reappointment of Mr. Henry Delvin to the Agricultural Extension Board for a term expiring August 30, 2005. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Williams moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Ms. Carol Edwards to the Agricultural Extension Board for a term expiring August 30, 2005. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Williams moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Mr. Bill Strasser to the Agricultural Extension Board for a term expiring August 30, 2005. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Ms. Williams moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Charter Revision Commission
Reappointment of Mr. Randy Kennedy to the Charter Revision Commission for a term expiring September 4, 2006. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Ms. Williams moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Mr. Michael Moore to the Charter Revision Commission for a term expiring September 4, 2006. In the absence of the appointee, the confirmation was deferred.

Electric Power Board
Appointment of Ms. Marguerite Sallee to the Electric Power Board for a term expiring July 1, 2007. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Ms. Williams moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Board of Health
Reappointment of Dr. Henry Foster to the Board of Health for a term expiring July 9, 2007. In the absence of the appointee, the confirmation was deferred.

Procurement Standards Board
Appointment of Ms. Maria Salas to the Procurement Standards Board for a term expiring July 20, 2005. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Ms. Williams moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.


- RESOLUTIONS -

RESOLUTION NO. RS2002-1099
A resolution approving the property at 3332 Sidco Drive to be used for a waste transfer station. Mr. Turner moved to withdraw the resolution at the request of the applicant, which motion was seconded and adopted by a voice vote of Council.


RESOLUTION NO. RS2002-1119

A resolution requesting the Mayor and the Employee Benefit Board to take necessary action, including submission of legislation, to freeze the costs of health insurance premium cost to employees of Metropolitan Government when they have twenty-five or more years of service. The Personnel-Public Information-Human Relations-Housing Committee recommended deferment of the resolution. Mr. Alexander moved to defer the resolution indefinitely, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2002-1120
A resolution requesting the Board of Parks and Recreation and the Traffic and Parking Commission to provide recreation and parking services without costs to employees of Metropolitan Government with twenty-five or more years of service. The Parks, Library, Recreation and Auditorium and Traffic and Parking Committees recommended deferment of the resolution. Mr. Alexander moved to defer the resolution indefinitely, which motion was seconded and adopted by a voice vote of the Council.


RESOLUTION NO. RS2002-1121

A resolution requesting the Mayor and the Department of Public Works to reinstitute the previous street paving policy. The resolution was disapproved by the Public Works Committee. Mr. Dillard moved to defer the resolution indefinitely, which motion was seconded and adopted by a voice vote of the Council.


RESOLUTION NO. RS2002-1123

A resolution providing amendments to the Charter of The Metropolitan Government of Nashville and Davidson County, Tennessee, in accordance with Article 19, Section 19.01, and setting forth a brief description of each amendment to be placed on the ballot.

Amendment No. 1 (Reducing the size of the Metropolitan Council to 25 members). The amendment was not recommended by the Charter Revision Commission and was disapproved by the Charter Revision Committee. Mr. Wallace moved to withdraw Amendment No. 1, which motion was seconded and adopted by a voice vote of the Council.

Amendment No. 2 (Requiring that all employees and officers of the Metropolitan Government be residents of Davidson County). The amendment was not recommended by the Charter Revision Commission and was disapproved by the Charter Revision Committee. Mr. Wallace moved to withdraw Amendment No. 2, which motion was seconded and adopted by a voice vote of the Council.

Amendment No. 3 (Prohibiting a member of an administrative board or commission from serving in any other public office or on any other board or commission). The amendment was not recommended by the Charter Revision Commission and was disapproved by the Charter Revision Committee. Mr. Wallace moved to withdraw Amendment No. 3, which motion was seconded and adopted by a voice vote of the Council.

Amendment No. 4 (Providing that members of the board of education may receive compensation at a rate approved by the Metropolitan Council). The amendment was recommended by the Charter Revision Commission and the Charter Revision Committee. Mr. Briley moved to withdraw the resolution, which motion was seconded and adopted by a voice vote of the Council.

A resolution requesting the Davidson County Election Commission to examine and report on the conduct of the August 1, 2002 election, the September 5, 2002 run-off election, and the general election of November 5, 2002, and report its findings to the Metropolitan Council. RESOLUTION NO. RS2002-1141
A resolution adopting a proposed plan of services for the extension of the boundaries of the Urban Services District to include certain properties located to the south of Briley Parkway and to the west of Dickerson Pike, more particularly described herein. The resolution was approved by the Planning, Zoning and Historical Committee. Mr. Majors moved to defer the resolution for a public hearing on October 1, 2002, which motion was seconded and adopted by a voice vote of the Council.

A resolution adopting the Floodplain Management Plan for The Metropolitan Government of Nashville and Davidson County. The resolution was approved by the Public Works Committee. RESOLUTION NO. RS2002-1143
A resolution appropriating $100,000 from the Reserve for Nashville Stand For Children Program Account of the General Fund of the General Services District and approving a grant to Tennessee Voices For Children, Inc. to provide partial funding for its program services. The resolution was approved by the Budget and Finance Committee; the Personnel-Public Information-Human Relations-Housing Committee recommended deferment. Mr. Briley moved to defer the resolution and to request the Clerk to set the next committee meeting at a time sufficient for consideration of this resolution and not in conflict with either the Education or Rules-Confirmations-Public Elections Committees, which motion was seconded and adopted by a voice vote of the Board.


RESOLUTION NO. RS2002-1144
A resolution supplementing Resolution No. RS2002-1124 to provide for the purchase, sale and terms of the District Energy System Revenue Bonds 2002 Series A of The Metropolitan Government of Nashville and Davidson County (Tennessee), and approving the official statement, the project feasibility report and the purchase and sale agreement for the 2002 Series A Bonds. Mr. Shulman offered a substitute resolution and moved that it be accepted for filing, which motion was seconded and adopted by a voice vote of the Council.


SUBSTITUTE RESOLUTION NO. RS2002-1144

A resolution supplementing Resolution No. RS2002-1124 to provide for the purchase, sale and terms of the District Energy System Revenue Bonds 2002 Series A of The Metropolitan Government of Nashville and Davidson County (Tennessee), and approving the official statement, the project feasibility report and the purchase and sale agreement for the 2002 Series A Bonds. The substitute resolution was approved by the Budget and Finance Committee.
