Metropolitan Council Meeting
Tuesday, September 3, 2002


The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilmember Chris Ferrell.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Ferrell, Waters, Briley, Tucker, Gilmore, Black, Nollner, Majors, Beehan, Campbell, Dillard, Balthrop, Brown, Ponder, Derryberry, Loring, McClendon, Greer, Hausser, Wallace, Whitmore, Hand, Bogen, Summers, Shulman, Arriola, Sontany, Alexander, Holloway, Kerstetter, Knoch, Jenkins, Turner, Williams, and President Pro Tem Gentry (35); Absent: Hall, Hart, Stanley, Haddox (4).

The Minutes of the regular meeting of August 20, 2002, were approved.


- ELECTIONS AND CONFIRMATIONS -

Electric Power Board
Appointment of Ms. Marguerite Sallee for a term expiring July 1, 2007. Without objection, the appointment of Ms. Sallee was withdrawn.

Tourism and Convention Commission
Reappointment of Ms. Shannon Bowles for a term expiring June 30, 2005. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Williams moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Ms. Sandra Fulton for a term expiring June 30, 2005. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Ms. Williams moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

A resolution honoring emergency workers during the month of September to commemorate the heroic efforts of emergency workers after the September 11, 2001 terrorist attacks in the United States.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS20 District to RM4 District property at Old Hickory Boulevard (unnumbered), abutting the southern terminus of Heritage Drive (3.57 acres), all of which is more particularly described herein (Proposal No. 2002Z-011G-04). The bill was approved by the Planning Commission. Mr. Nollner requested a hearing from the public on this bill which had been previously advertised. BILL NO. BL2002-1112
An ordinance amending Title 17 of the Metropolitan Code, Zoning Regulations, by amending Section 17.04.060 Definitions by adding a definition for Recycling Facility, by amending Section 17.08.030 and Section 17.16.110 by designating zone districts where a Recycling Facility shall be permitted and establishing conditions for such a facility when permitted by conditions, all of which is more particularly described herein (Proposal No. 2002Z-020T). Mr. Briley moved to defer the bill indefinitely, which motion was seconded and adopted by a voice vote of the Council.


BILL NO. BL2002-1126
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a District to RS10 District property at Maxwell Road (unnumbered), at the intersection of Maxwell Road and LaVergne Couchville Pike, (1.65 acres), all of which is more particularly described herein (Proposal No. 2002Z-039G-13). The bill was approved by the Planning Commission. Ms. Holloway requested a hearing from the public on this bill which had been previously advertised. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending the Planned Unit Development District abutting the east margin of Murfreesboro Pike between Hickory Woods Drive and LaVergne-Couchville Pike, classified within the R10, CS, and CL Districts, (12.71 acres), to add three undeveloped parcels of land totaling 2.29 acres and to permit the development of a 97,718 square foot retail shopping center, replacing 108,600 square feet of undeveloped retail (Proposal No. 72-86-P-13). After discussion, Mr. Alexander called for the previous question, which motion was seconded and adopted by a voice vote of the Council. Mr. Alexander subsequently withdrew his motion. After further discussion, Mr. Bogen called for the previous question, which motion was seconded and adopted by a voice vote of the Commission. The matter recurred on Ms. Holloway’s motion to pass on second reading and to defer for two meetings, which motion was adopted by a voice vote of the Council.

Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission, Budget and Finance; Parks, Library, Recreation and Auditorium; and Planning, Zoning and Historical Committees by a voice vote of the Council.


BILL NO. BL2002-1173
An ordinance authorizing the Police Department of the Metropolitan Government of Nashville and Davidson County to accept a donation of $1,507.05 from the Carl Williams 5K Walk/Run For Victims Rights for the benefit of the Police Department’s Victim Intervention Program. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Safety-Beer, Wine and Whiskey Committees by a voice vote of the Council.

An ordinance authorizing the Police Department of The Metropolitan Government of Nashville and Davidson County to receive the Lost Child Alert Technology Resource from the National Center for Missing and Exploited Children. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Safety-Beer, Wine and Whiskey Committees by a voice vote of the Council.


BILL NO. BL2002-1176
An ordinance accepting a grant from the State of Tennessee, Department of Military, Tennessee Emergency Management Agency to The Metropolitan Government of Nashville and Davidson County in an amount not to exceed $200,000 to purchase personnel protective and detection equipment for emergency first responders to a weapons of mass destruction incident. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Safety-Beer, Wine and Whiskey Committees by a voice vote of the Council.

BILL NO. BL2002-1177
An ordinance approving an agreement between the State of Tennessee, Department of Transportation and The Metropolitan Government of Nashville and Davidson County for reimbursement of funds expended for litter pickup. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Safety-Beer, Wine and Whiskey Committees by a voice vote of the Council.

An ordinance abandoning a sewer drainage easement on Map 72-14, Parcel 031.00 of Project No. 02-SG-92 CVS Pharmacy, Sewer Drainage and Easement Abandonment located at 2516 Gallatin Avenue (Proposal No. 2002M-074U-05). Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.

An ordinance amending the Official Street and Alley Acceptance and Maintenance Map for the Metropolitan Government of Nashville and Davidson County, Tennessee, by accepting the dedication of Recovery Road and associated right-of-way (Proposal No. 2001S-343U-12). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works, Traffic and Parking, and Planning, Zoning, and Historical Committees by a voice vote of the Council.

An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County by closing a portion of Old U.S. Highway 70 South (Proposal No. 2002M-054G-06). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Traffic and Parking Commission, Public Works, Traffic and Parking, and Planning, Zoning, and Historical Committees by a voice vote of the Council.


Without objection, the rules were suspended for consideration of one (1) late bill.

An ordinance authorizing HCA Realty, Inc., to construct, install, and maintain a pole sign within the right-of-way adjacent to Recovery Road (Proposal No. 2002M-018U-12. Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission, Traffic and Parking Commission, Public Works, Traffic and Parking, and Planning, Zoning, and Historical Committees by a voice vote of the Council.
