Metropolitan Council Meeting
Tuesday, July 16, 2002


The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Reverend John Bledsoe of Old Hickory Church of the Nazarene.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The Minutes of the regular meeting of July 2, 2002 were approved.

- ELECTIONS AND CONFIRMATIONS -

Auditorium Commission
Reappointment of Ms. Jane Cleveland to the Auditorium Commission for a term expiring June 30, 2005. In the absence of the appointee, the appointment was deferred.

Appointment of Ms. Carol Singletary to the Auditorium Commission for a term expiring June 30, 2005. In the absence of the appointee, the appointment was deferred.

Community Access Television Special Committee
Appointment of Ms. Meg Mazzone to the Community Access Television Special Committee for a term expiring March 1, 2003. In the absence of the appointee, the appointment was deferred.

Public, Educational and Governmental Access Committee
Appointment of Ms. Hazel Thomas to the Public, Educational and Governmental Access Committee for a term expiring November 4, 2003. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Williams moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Ms. Williams, chair of the Rules-Confirmations-Public Committee, reported that four members of the Metropolitan Historical Commission who were appointed and confirmed to that body in August 1999 were incorrectly appointed for three year terms at that time, as the Metropolitan Code of Laws establishes four-year terms for members of that Commission. Ms. Williams moved that the terms of the Robert T. Cochran III, Wilbur F. Creighton Jr., Gary Everton, and Laura Rost be corrected to expire in August 1, 2003, which motion which motion was seconded and adopted by a voice vote of the Board.

- BILL ON PUBLIC HEARING -


BILL NO. BL2002-1115
An ordinance approving the development of low-rent scattered site housing. The bill was approved by the Federal Grants Review and Personnel-Public Information-Human Relations-Housing Committees. Mr. Whitmore requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill, and no one came forward to be heard. The President declared the public hearing closed. Mr. Whitmore offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Mr. Whitmore moved to defer the bill and re-refer to the Planning Commission, which motion was withdrawn without objection. Mr. Whitmore moved to pass the bill on second reading as amended, which motion was seconded and adopted by a voice vote of the Council.

President Gentry assumed the chair at this time.

RESOLUTION NO. RS2002-1074
A resolution authorizing the Metropolitan Government to enter into Utility Relocation Contract No. 5868 with the State of Tennessee, Department of Transportation, for Distribution and Collection System Relocations, said construction being necessary as part of State Project No. CM-STP-1(74), 19019-2219-54, SR 1 (West End Avenue) from I-440 to Acklen Park Drive (Metro Project Nos. 01-SG-120/01-WG-115) and ratifying an agreement with the Treasury Department of the State of Tennessee. The resolution was approved by the Budget and Finance and Public Works Committees. RESOLUTION NO. RS2002-1075
A resolution authorizing the acquisition of an easement in real property by negotiation for use in a public project for The Metropolitan Government of Nashville and Davidson County and specifically with relation to the construction of a North Nashville Police Precinct and the granting of an easement in real property by the Metropolitan Government to the grantor as consideration for the easement (Proposal No. 2002M-063U-08). The resolution was approved by the Planning Commission, Budget and Finance, Public Safety-Beer, Wine and Whiskey and Planning, Zoning and Historical Committees. A resolution proclaiming the week of July 14-20, 2002, as Catholic Charities of Tennessee Week in recognition of the contributions to the quality of life that have been made by Catholic Charities of Tennessee. A resolution requesting the Mayor and the Metropolitan Employee Benefit Board to submit legislation that would increase the method of pension calculation for general employees of the Metropolitan Government from one and seventy-five one-hundredths percent (1.75%) of average earnings to two percent (2%) of average earnings. The resolution was approved by the Personnel-Public Information-Human Relations-Housing Committee. Ms. Hand moved to adopt the resolution, which motion was seconded. Mr. Ponder moved to defer action on the resolution, which motion was seconded and failed by a voice vote of the Council. BILL NO. BL2002-1128
An ordinance deleting Title 12, Section 12.08.210 of the Metropolitan Code of Laws and inserting a new Section 12.08.210 changing the definition of “abandoned motor vehicle” and providing for abandoned personal property. Upon motion duly seconded, the bill passed first reading and was referred to the Codes, Fair and Farmers Market Committee by a voice vote of the Council.

BILL NO. BL2002-1129
An ordinance approving a grant from the U.S. Department of Justice, Bureau of Justice Assistance to The Metropolitan Government of Nashville and Davidson County, acting through the Metropolitan Police Department for the Bulletproof Vest Partnership Grant. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Safety-Beer, Wine and Whiskey Committees by a voice vote of the Council.

BILL NO. BL2002-1130
An ordinance readopting the Code of The Metropolitan Government of Nashville and Davidson County, Tennessee, prepared by Book Publishing Company, including supplemental and replacement pages thereof, containing certain ordinances of a general and permanent nature enacted on or before May 24, 2002. BILL NO. BL2002-1131
An ordinance authorizing the Director of the Metropolitan Board of Parks and Recreation to enter into a lease agreement with the State of Tennessee for certain property located at the Ellington Agriculture Center on Edmondson Pike for use as a public park (2002M-075U-12). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission, Budget and Finance, Parks, Library, Recreation and Auditorium and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2002-1132
An ordinance approving the conveyance, subject to certain retained easements, of a fee simple interest in one parcel of real property and a permanent easement in a second parcel to the Nashville & Eastern Railroad Authority in connection with construction of the Gateway Boulevard project (2002M-031U-09). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.


BILL NO. BL2002-1133
An ordinance authorizing the acquisition of property by negotiation or condemnation for the purpose of acquiring utility easements for use in public projects of the Metropolitan Government and specifically with relation to Project Numbers 01-SG-91, 01-WG-88, Phase V, and 01-SG-92, 01-WG-89, Phase IV, Briley Parkway widening from Elm Hill Pike to Windemere Drive, by TDOT (Proposal No. 2002M-040U-14). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance, Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2002-1066
An ordinance granting the consent of The Metropolitan Government of Nashville and Davidson County to the assignment and transfer of control of the Cable Television Franchise and Cable Television System from Comcast Corporation to AT&T Comcast Corporation. Mr. Briley offered a substitute bill and moved that it be accepted for filing and no objection was made.

SUBSTITUTE BILL NO. BL2002-1066
A substitute ordinance granting the consent of The Metropolitan Government of Nashville and Davidson County to the assignment and transfer of control of the Cable Television Franchise and Cable Television System from Comcast Corporation to AT&T Comcast Corporation. The substitute bill was approved by the CATV Special Committee and the Budget and Finance Committee. Mr. Briley moved to pass the substitute bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2002-1075
An ordinance regulating the use and operation of horse-drawn carriages within the area of The Metropolitan Government of Nashville and Davidson County. The bill was approved by the Budget and Finance, Transportation and Public Safety-Beer, Wine and Whiskey Committees with an amendment. Mr. Briley offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Mr. Derryberry moved defer action on the bill, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2002-1102
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a and CS districts to RS15 district properties at 8161 Coley Davis Road, Newsom Station Road (unnumbered), and McCrory Lane (unnumbered), (264.39 acres), all of which is more particularly described herein (Proposal No. 2001Z-077G-06). The bill was approved by the Planning Commission and Planning, Zoning and Historical Committee. Mr. Lineweaver moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2002-1116
An ordinance amending Chapter 8.20 of the Metropolitan Code by prohibiting the feeding of fowl in any street, alley, road, sidewalk, or other public way within the urban services district. The bill was approved by the Health, Hospitals and Social Services Committee; the Public Works Committee recommended disapproval. Mr. Wallace offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Mr. Wallace moved to pass the bill on second reading as amended, which motion was seconded and adopted by a voice vote of the Council.

An ordinance approving a grant in the amount of $1,055.63 to The Metropolitan Government of Nashville and Davidson County, acting through the Davidson County Election Commission, from the State of Tennessee, Department of State, Division of Elections, for the purchase of equipment to upgrade the Automated Electoral System. The bill was approved by the Budget and Finance and Rules-Confirmations-Public Elections Committee. An ordinance authorizing the Director of Parks and Recreation, or his designee, to accept, execute and record an agreement for grant of an easement with Kohl’s Department Stores, Inc., on a parcel of property for use in the Stones River greenway system (2002M-062G-14). An ordinance accepting an easement from Belmont University with a provision to abandon the sewer line in the future Project No. 99-SG-244. An ordinance authorizing the State of Tennessee to construct, install, and maintain certain improvements within the public right-of-way at the Tennessee Performing Arts Center (2002M-032U-09).
