Metropolitan Council Meeting
Tuesday, August 15, 2000

The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Father Joseph Breen of St. Edward's Catholic Church.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Ferrell, Waters, Briley, Gentry, Tucker, Gilmore, Nollner, Majors, Hall, Beehan, Campbell, Hart, Dillard, Balthrop, Brown, Ponder, Derryberry, Stanley, Loring, McClendon, Greer, Hausser, Wallace, Whitmore, Hand, Summers, Shulman, Arriola, Sontany, Alexander, Kerstetter, Knoch, Jenkins, Turner, Williams, and Lineweaver (36); Absent: Black, Haddox, Bogen, Holloway, and President Steine (5).

President Pro Tem Ferrell presided in the absence of President Steine.

The Minutes of the regular meeting of August 1, 2000, were approved.


- ELECTIONS AND CONFIRMATIONS -


Auditorium Commission
Appointment of Ms. Beth Seigenthaler Courtney for a term expiring June 30, 2003. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Waters moved for confirmation, which motion was seconded and adopted by a voice vote of the Council.

Community Corrections Advisory Board
Reappointment of Mr. Michael Miller for a term expiring July 30, 2002. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Waters moved for confirmation, which motion was seconded and adopted by a voice vote of the Council.

Historic Zoning Commission
Reappointment of Ms. Cori Morris for a term expiring June 1, 2005. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Waters moved for confirmation, which motion was seconded and adopted by a voice vote of the Council.

Board of Public Education
The President stated that an election would be held at this time to fill a vacancy on the Metropolitan Board of Public Election for School District 8, nominations having been previously made for the candidacies of Sharon L. Bell and David L. Kleinfelter. Mr. Waters, Chairman of the Rules-Confirmations-Public Elections Committee, reported that both candidates had been found to be qualified for the position. The ballot was taken and the following vote recorded: Bell - Waters, Tucker, Gilmore, Majors, Balthrop, Brown, McClendon, Sontany, Kerstetter, Knoch, Jenkins (11); Kleinfelter - Ferrell, Briley, Gentry, Nollner, Hall, Beehan, Campbell, Hart, Ponder, Derryberry, Stanley, Loring, Greer, Hausser, Wallace, Whitmore, Hand, Summers, Shulman, Arriola, Alexander, Turner, Williams, Lineweaver (24). The President declared that Mr. Kleinfelter was elected to fill the vacancy on the Board of Public Education.


- RESOLUTIONS -
RESOLUTION NO. RS2000-274
A resolution requesting the Mayor and the Metropolitan Board of Public Education to furnish information to the Metropolitan Council relating to the broad number of employees who reside out of county and the economic impact on Metro as a result of such out-of-county resident employees. The resolution was approved by the Public Works Committee. The Public Safety-Beer, Wine and Whiskey; Education; Personnel-Public Information-Human Relations-Housing; and Transportation and Aviation Committees recommended deferment. Mr. Wallace moved to defer the resolution indefinitely until a substitute resolution is prepared, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2000-300
A resolution requesting Nashville Electric Service to provide public service announcements on radio and television that disclose areas of Metropolitan Government without electric power and the expected duration of such outages. The resolution was approved by the Public Safety-Beer, Wine and Whiskey Committee. Mr. Greer moved to defer the resolution indefinitely pursuant to discussions with NES officials, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2000-309
A resolution expressing support of the Nashville Publishers Co-op's efforts in installing modular newspaper racks. Mr. Lineweaver offered a substitute resolution and moved that it be accepted for filing, and no objection was made.

SUBSTITUTE RESOLUTION NO. RS2000-309
A substitute resolution expressing support of the Nashville Publishers Co-op's efforts in installing modular newspaper racks. The substitute resolution was approved by the Rules-Confirmations-Public Elections and Traffic and Parking Committees. Mr. Lineweaver moved to defer the resolution for additional discussion with the parties involved, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2000-310
A resolution authorizing the employment of Donald W. Jones as special counsel and director of the Council Research Staff for the Metropolitan County Council. The resolution was approved by the Executive Committee and Budget and Finance Committee. A resolution authorizing the Metropolitan Board of Public Education to incur debt in an amount not to exceed $90,921.00 for the lease/purchase of a printing press over a term of five (5) years. The resolution was approved by the Budget and Finance and Education Committees. RESOLUTION NO. RS2000-312
A resolution granting a period of time to the CATV Special Committee until September 12, 2000, to review and report to the Metropolitan Council regarding the applications for cable television franchises by Knology of Nashville, Inc., and Digital Access Corporation of Tennessee, Inc. The resolution was approved by the Budget and Finance Committee with an amendment. Mr. Waters offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted without objection. A resolution approving a contract for a grant in the amount of $208,200.00 from the State of Tennessee Department of Health to The Metropolitan Government of Nashville and Davidson County acting by and through the Metropolitan Board of Health for the provision of nutritious food to low-income women, infants and children who are vulnerable to inadequate nutrition. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees. The resolution was approved by the Planning Commission and Planning, Zoning and Historical Committee; the Public Works Committee recommended deferment. Mr. Whitmore moved to defer the resolution so that certain issues can be resolved, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2000-372
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6 District to CS District property at 6006 Morrow Road, approximately 145 feet west of 60th Avenue North (.17 acres), (Proposal No. 2000Z-086U-07), all of which is more particularly described herein. Ms. Hand moved to re-refer the bill to the Planning Commission, which motion was seconded and adopted by a voice vote of the Council.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RM20 District to MUG District 69 properties between the east margin of the CSX Railroad and the west margin of D. B. Todd Boulevard, abutting the north and south margins of Meharry Boulevard, Albion Street, and Morena Street (29.09 acres) and from OR20 District to MUG District one property at 1909 Morena Street (.19 acres), (Proposal No. 2000Z-017U-08), all of which is more particularly described herein. The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2000-394
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R15 and R20 Districts to RM4 District properties at Sawyer Brown Road (unnumbered) and Old Hickory Boulevard (unnumbered), approximately 1,900 feet south of Ridgelake Parkway (58.81 acres), (Proposal No. 2000Z-073G-06), all of which is more particularly described herein. The bill was disapproved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.

An ordinance creating a nullification fee for citations involving a violation of Section 10.60.100B of the Metropolitan Code of Laws. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.

An ordinance approving a grant from the U.S. Department of Justice, Bureau of Justice Assistance to The Metropolitan Government of Nashville and Davidson County, acting through the Metropolitan Police Department for the Bulletproof Vest Partnership Grant. An ordinance approving a grant from the U.S. Department of Justice to The Metropolitan Government of Nashville and Davidson County, acting through the Office of Emergency Management to purchase equipment to ensure that public safety personnel are properly equipped to respond to possible incidents of domestic terrorism. An ordinance approving a cost-sharing agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Parks and Recreation, and the Department of the Army and appropriating the sum of Forty-Eight Thousand Dollars ($48,000) for planning work relating to the Richland Creek Greenway. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a District to RS10 District property abutting the north margin of Pettus Road (54.16),(Proposal No. 99Z-103G), all of which is more particularly described herein. The bill was approved by the Planning Commission and Planning, Zoning and Historical Committee. Mr. Knoch moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2000-160
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from OR20 District to CL District property at 4400 Nolensville Pike, abutting the north margin of Goins Road (1.94 acres), (Proposal No. 2000Z-009U-12), all of which is more particularly described herein. The bill was approved by the Planning Commission. Ms. Arriola moved to withdraw the bill because of new ownership of the property in question, the bill being requested by Barge, Waggoner, Sumner and Cannon for Southeast Chrysler/Plymouth/Jeep, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2000-161
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by canceling the Commercial (General) Planned Unit Development District located abutting the east margin of Nolensville Pike and the south margin of Goins Road, classified OR20 and proposed for CL District (1.94 acres), containing an existing 6,330 square foot restaurant use, (Proposal No. 231-77-U-12), all of which is more particularly described herein. The bill was approved by the Planning Commission. Ms. Arriola moved to withdraw the bill because of new ownership of the property in question, the bill being requested by Barge, Waggoner, Sumner and Cannon for Southeast Chrysler/Plymouth/Jeep, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2000-377
An ordinance adopting property identification maps for The Metropolitan Government of Nashville and Davidson County which shall be the official maps for the identification of real estate for tax assessment purposes. The bill was approved by the Planning, Zoning and Historical Committee. Ms. Balthrop moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2000-378
An ordinance amending Section 11.12.070 of the Metropolitan Code by regulating excessive noise and hours of operation of entertainment establishments providing amplified sound. The Public Safety-Beer, Wine and Whiskey Committee recommended deferment of the bill. Mr. Stanley moved to defer the bill indefinitely, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2000-379
An ordinance accepting a grant agreement between the State of Tennessee, Department of Finance and Administration, Office of Criminal Justice Programs, and The Metropolitan Government of Nashville and Davidson County for improvement of the criminal justice system as provided by a drug control and systems improvement grant, specifically, the Edward Byrne Memorial Formula Grant Program. The bill was approved by the Budget and Finance and Public Safety-Beer, Wine and Whiskey Committees. Mr. Knoch moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

An ordinance approving a grant from the State of Tennessee, Tennessee Department of Labor and Workforce Development, to The Metropolitan Government of Nashville and Davidson County, for the provision of establishing programs to prepare dislocated workers for re-entry into the labor force to be administered through the Nashville Career Advancement Center. An ordinance approving a grant from the State of Tennessee, Tennessee Department of Labor and Workforce Development, to The Metropolitan Government of Nashville and Davidson County, for additional funding in administering the program to prepare dislocated workers to re-enter the workforce, to be administered through the Nashville Career Advancement Center. An ordinance authorizing the acceptance of a proposal to The Metropolitan Government of Nashville and Davidson County from the State of Tennessee. Department of Transportation relating to Project NH-155(13); 19076-2238-14, Briley Parkway (SR-155) from south of Glastonbury to north of Elm Hill Pike and authorizing the approval by resolution of the Metropolitan Council for utility relocation, maintenance of traffic signals and/or street lighting or other documents associated with this project. An ordinance authorizing the acceptance of a proposal to The Metropolitan Government of Nashville and Davidson County from the State of Tennessee.
