The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Reverend Richard Van Dyke of Donelson Church of Christ.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The Minutes of the regular meeting of July 18, 2000, were approved.

- ELECTIONS AND CONFIRMATIONS -

Farmers Market Board

Appointment of Ms. Marcia Jervis for a term expiring July 5, 2001. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Waters moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

- RESOLUTIONS -


RESOLUTION NO. RS2000-274
A resolution requesting the Mayor and the Metropolitan Board of Public Education to furnish information to the Metropolitan Council relating to the broad number of employees who reside out of county and the economic impact on Metro as a result of such out-of-county resident employees. The Education Committee recommended deferment of the resolution. Mr. Wallace moved to defer the resolution, upon the committee recommendation, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2000-275
A resolution requesting the Metropolitan Mayor to consider taking steps to renegotiate the Economic Development Agreement with Dell Computer Corporation. The resolution was disapproved by the Budget and Finance Committee. Mrs. Tucker moved to adopt the resolution, which motion was seconded. Mr. Waters moved to table the resolution, which motion was seconded and adopted by the following vote: "Ayes" Ferrell, Waters, Briley, Gentry, Black, Majors, Campbell, Balthrop, Brown, Ponder, Stanley, Loring, McClendon, Hausser, Haddox, Shulman, Arriola, Sontany, Alexander, Holloway, Kerstetter, Jenkins, Turner, and Williams (24); "Noes" Tucker, Hall, Hart, Derryberry, Greer, Wallace, Whitmore, Bogen, and Knoch (9); "Abstaining" Hand, Lineweaver (2).

RESOLUTION NO. RS2000-300
A resolution requesting Nashville Electric Service to provide public service announcements on radio and television that disclose areas of Metropolitan Government without electric power and the expected duration of such outages. The Public Safety-Beer, Wine and Whiskey Committee recommended deferment of the resolution. Mr. Greer moved to defer the resolution, upon the committee recommendation, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2000-301
A resolution authorizing acceptance of Tennessee Housing Development Agency 2000 State Local Match program entitlement funds (formerly known as HOUSE funds). The resolution was approved by the Federal Grants Review Committee. Mr. Haddox moved to adopt the resolution, which motion was seconded and adopted by the following vote: "Ayes" Ferrell, Waters, Briley, Gentry, Black, Majors, Hall, Campbell, Hart, Balthrop, Brown, Ponder, Derryberry, Stanley, Loring, McClendon, Greer, Hausser, Wallace, Haddox, Whitmore, Hand, Bogen, Shulman, Arriola, Sontany, Alexander, Holloway, Kerstetter, Knoch, Jenkins, Turner, Williams, and Lineweaver (34); "Noes" (0).

RESOLUTION NO. RS2000-302
A resolution appropriating $85,000 in Community Development Block Grant funds for the construction of sidewalks on Katie Avenue in the Fern Avenue Neighborhood Strategy Area. The resolution was approved by the Federal Grants Review Committee. RESOLUTION NO. RS2000-303
A resolution approving the amendment of the contract between the State and the Sheriff's Department terminating the current agreement on June 30, 2000, instead of June 30, 2002. A resolution appropriating $59,189,996.00 from the General Fund of the General Services District to the Metropolitan Hospital Authority for purposes of making a loan to the Metropolitan Hospital Authority. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending Section 17.04.060 regarding the filing of a zone change application, all of which is more particularly described herein. Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2000-363
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by applying the provisions of the Urban Zoning Overlay District to properties within Davidson County, (Proposal No. 2000Z-094U-00), all of which is more particularly described herein. The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.
After discussion, Mr. Wallace moved to rescind action on the bill, which motion was seconded and adopted without objection. Mr. Wallace moved to withdraw the bill because of notice problems, which motion was seconded and adopted by a voice vote of the Council.

An ordinance to amend various sections of Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of the Metropolitan Government of Nashville and Davidson County (2000Z-021T), all of which is more particularly described herein. The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2000-365
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of the Metropolitan Government of Nashville and Davidson County, by amending various sections to establish provisions for a Neighborhood Landmark District and Neighborhood Landmark Development Plan (2000Z-022T), all of which is more particularly described herein. BILL NO. BL2000-375
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by canceling an undeveloped portion and amending a portion of the Residential/Commercial Planned Unit Development Districts located abutting the west margin of Nolensville Pike, 500 feet north of Brentwood Highlands Drive, classified SCN (8.27 acres), to cancel a portion of the commercial part of the PUD approved for 52,000 square feet of office uses, 78,000 square feet of retail uses, and a 2,500 square foot restaurant, (Proposal No. 78-86-P-12), all of which is more particularly described herein. BILL NO. BL2000-376
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by canceling an undeveloped portion and amending a portion of the Residential Planned Unit Development District located abutting the west margin of Nolensville Pike, north of Brentwood Highlands Drive, classified R10 (27.67 acres), to cancel the undeveloped northern portion of the PUD approved for 396 multi-family units, (Proposal No. 62-85-P-12), all of which is more particularly described herein.

BILL NO. BL2000-377
An ordinance adopting property identification maps for The Metropolitan Government of Nashville and Davidson County which shall be the official maps for the identification of real estate for tax assessment purposes. Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and the Planning, Zoning and Historical Committee by a voice vote of the Council.

An ordinance amending Section 11.12.070 of the Metropolitan Code by regulating excessive noise and hours of operation of entertainment establishments providing amplified sound. Upon motion duly seconded, the bill passed first reading and was referred to the Public Safety-Beer, Wine and Whiskey Committee by a voice vote of the Council.

BILL NO. BL2000-379
An ordinance accepting a grant agreement between the State of Tennessee, Department of Finance and Administration, Office of Criminal Justice Programs, and The Metropolitan Government of Nashville and Davidson County for improvement of the criminal justice system as provided by a drug control and systems improvement grant, specifically, the Edward Byrne Memorial Formula Grant Program. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.

An ordinance approving a grant from the State of Tennessee, Tennessee Department of Labor and Workforce Development, to The Metropolitan Government of Nashville and Davidson County, for the provision of establishing programs to prepare dislocated workers for re-entry into the labor force to be administered through the Nashville Career Advancement Center. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.

An ordinance approving a grant from the State of Tennessee, Tennessee Department of Labor and Workforce Development, to The Metropolitan Government of Nashville and Davidson County, for additional funding in administering the program to prepare dislocated workers to re-enter the workforce, to be administered through the Nashville Career Advancement Center.
