Metropolitan Council Meeting

Tuesday, June 23, 1998


The Metropolitan Council met in an adjourned session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilmember Phil Ponder.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Varallo, Armistead, Steine, Ferrell, Waters, Patton, Black, Nollner, Majors, Harrison, Beehan, Campbell, Hart, Dillard, Garrett, Wooden, Ponder, French, Stanley, Dale, Graves, Douglas, Clifton, Sloss, Haddox, McCallister, Holt, Crafton, Johns, Kleinfelter, Arriola, Sontany, Hall, Holloway, Hollis, Alexander, Jenkins, Turner, Fentress, Lineweaver, and President West (41); Absent: (0).

The Minutes of the regular meeting of June 16, 1998 were approved.

Councilmember Beehan moved to call up Bill Nos. O98-1237 and O98-1238 for consideration at this time, and no objection was made.

BILL NO. O98-1237

A bill to be entitled: The budget ordinance of The Metropolitan Government of Nashville and Davidson County, Tennessee for the fiscal year 1998-99. Ms. Beehan offered a substitute bill and moved that it be accepted for filing and no objection was made.

A substitute bill to be entitled: The budget ordinance of The Metropolitan Government of Nashville and Davidson County, Tennessee for the fiscal year 1998-99. The substitute bill was approved by the Budget and Finance Committee. Ms. Beehan moved to pass the substitute bill on third reading, which motion was seconded. Mr. Garrett offered Amendment No. 1 and moved for its adoption, which motion was seconded. The amendment was disapproved by the Budget and Finance Committee. Ms. Beehan moved to table the motion to amend, which motion was seconded and adopted by a roll call vote of the Council. Mr. Holt offered Amendment No. 2 and moved for its adoption, which motion was seconded. The amendment was disapproved by the Budget and Finance Committee. Ms. Beehan moved to table the motion to amend, which motion was seconded and failed by a roll call vote of the Council. After discussion Mr. Hall called for the previous question, which motion was adopted without objection. The matter recurred on the motion to adopt Amendment No. 2, which motion was adopted by a roll call vote of the Council. An ordinance establishing the tax levy in the General Services District for the fiscal year 1998-99, and declaring the amount required for the annual operating budget of the Urban Services District, pursuant to Section 6.07 of the Metropolitan Charter. The bill was approved by the Budget and Finance Committee. Ms. Beehan moved to pass the bill on third reading, which motion was seconded and adopted by the following vote: "Ayes" Varallo, Armistead, Steine, Ferrell, Waters, Black, Majors, Beehan, Ponder, Stanley, Dale, Douglas, Clifton, Sloss, Haddox, McCallister, Holt, Crafton, Johns, Kleinfelter, Sontany, Holloway, Jenkins, Turner, Fentress (25); "Noes" Patton, Nollner, Harrison, Campbell, Hart, Dillard, Garrett, Wooden, Graves, Arriola, Hollis, Alexander, Lineweaver (13); "Abstaining" French (1).

An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, by closing Alley 653 from Hillside Avenue to Alley 655, Vernon Avenue from Hillside to its western terminus, and Reservoir Court (Proposal No. 98M-034U), all of which is more particularly described herein. The bill was approved by the Planning Commission, Traffic and Parking Commission, Public Works, Traffic and Parking and Planning, Zoning, Historical and Port Authority Committees. Mr. Douglas moved to pass the bill on third reading, which motion was seconded and adopted by the following vote: "Ayes" Varallo, Armistead, Steine, Ferrell, Waters, Patton, Black, Nollner, Majors, Harrison, Beehan, Campbell, Hart, Dillard, Garrett, Wooden, Ponder, French, Stanley, Dale, Graves, Douglas, Clifton, Sloss, Haddox, McCallister, Holt, Crafton, Johns, Kleinfelter, Arriola, Sontany, Hall, Holloway, Hollis, Alexander, Jenkins, Turner, Fentress, Lineweaver (40); "Noes" (0).

An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, by closing a segment of Alley No. 1839 between Newsome Street and its southern terminus (Proposal No. 98M-043U), all of which is more particularly described herein. The bill was approved by the Planning Commission, Traffic and Parking Commission, Public Works, Traffic and Parking and Planning, Zoning, Historical and Port Authority Committees. An ordinance to amend The Official Street and Alley Acceptance and Maintenance Map for the Metropolitan Government of Nashville and Davidson County, by closing a portion of Chester Avenue between the west property line of Parcel 231 on Map 72-15 and Pennington Avenue, and to close a portion of Pennington Avenue between Chester Avenue and the north property line of Parcel 227 on Map 72-15 (Proposal No. 98M-055U), all of which is more particularly described herein. The bill was approved by the Planning Commission, Traffic and Parking Commission, Public Works, Traffic and Parking and Planning, Zoning, Historical and Port Authority Committees.
